Amigos: Mucho hemos leido por aqui la cantidad de fallos en los subchasis de los serie 3 E46, (puente de suspension y anclajes) abarcando a los modelos de los periodos 1999 a 2006. Al respecto ha salido un fallo en USA - California originada en una Queja de Accion colectiva contra BMW Norteamerica, segun la misma (traduzco y sintetizo) " la carga y descarga y/o la utilizacion normal de vehiculo puede debilitar el subchasis y desprenderlo del bastidor. La presentacion judicial manifiesta que BMW si sabia de este problema, pero no notifico correctamente a sus clientes ni absorbio los costos de reparacion. Asi las cosas el 3 de Marzo del corriente, el Juez Dean D. Pregerson determino la aprobacion preliminar de una sentencia que exigiria a BMW ya sea el reembolso a los clientes de los gastos incurridos o bien el establecimiento de un programa de inspeccion y reparación con vigencia de un año.. La sentencia definitiva seria dictada por el tribunal el 03 de Agosto de 2009 El grupo de abogados que intervino en el tema pertenece al estudio americano Girard Gibbs LLP. El fallo en ingles (por si no traduje algo correctamente) Proposed Class Settlement for Owners and Lessees of 1999-2006 BMW 3 Series Vehicles On October 24, 2006, Girard Gibbs and Wasserman, Comden & Casselman, LLP, filed a class action complaint against BMW of North America, alleging that 1999-2006 BMW 3 Series vehicles suffer from defective sub-frames. According to the complaint, the constant loading and unloading associated with normal driving can weaken the sub-frame to the point where it cracks and separates from the chassis, resulting in thousands of dollars of damage to the vehicle. The complaint alleges that BMW was aware of the alleged sub-frame defect, but failed to notify consumers or pay for sub-frame repairs under warranty. On March 3, 2009, Hon. Judge Dean D. Pregerson granted preliminary approval of a proposed class settlement, under which BMW will reimburse E46 owners or lessees in full for their sub-frame repair expenses. As part of the settlement, BMW has also agreed to implement a National Sub-Frame Inspection and Repair Program. All current owners and lessees of a 1999-2006 BMW 3 series vehicle will be notified of the sub-frame problem and will have one year to present their vehicle for a free inspection and repair (if needed). The Court is scheduled to decide whether to finally approve the proposed settlement on August 3, 2009.
